Before this Court is Plaintiff's objection to this Court's Report and Recommendation at ECF No. 35. ECF No. 36. This Court notes that Plaintiff indicates he has submitted summons to be served via publication in the Las Vegas Review Journal for Defendant Zimmerman and by email for Defendant Leavitt and withdraws its Report and Recommendation at ECF No. 35. Excusable neglect appearing, this Court also extends the 4(m) proof of service deadline nunc pro tunc by an additional 60 days. See Fed. R. Civ. P. 6(b). Accordingly, proof of service as to Defendants Zimmerman and Leavitt is due by 10/7/2026.
